Terms of Service
Effective September 1, 2026 · Last updated October 1, 2026
These Terms are an agreement between you and Day Boil Studios LLC, 407 Southbridge Pass, Peachtree City, GA 30269, United States (“Tuck,” “we,” “us”). They govern the Tuck website, apps, browser extension, and hosted services (the “Service”). You agree to these Terms when you expressly accept them while creating an account or purchasing a plan. Our Privacy Policy explains how we handle personal information. Send privacy requests to privacy@tuckthis.app.
1. Who may use Tuck
You must be at least 13 years old, or any higher minimum age required where you live. If you are below the age of legal adulthood, your parent or legal guardian must approve your use and accept these Terms on your behalf. Tuck is not offered to children under 13. If we learn that an account belongs to a child below the applicable minimum age, we will restrict access and take appropriate steps to delete their personal information, subject to legal requirements. If you use Tuck for an organization, you represent that you have authority to accept these Terms for it. You may use Tuck for your own personal or business work, subject to your plan. Accounts may be created internationally where providing the Service is lawful; particular features and payment methods may not be available everywhere. Supported billing currencies do not determine your legal rights or guarantee local SMS availability. You must comply with applicable export-control and sanctions laws.
Provide accurate account and billing information. Keep your sign-in credentials, recovery materials, devices, integration credentials, and API tokens secure. Each individual account is for one person; use supported sharing features to collaborate. Notify support@tuckthis.app if you suspect unauthorized access. You are responsible for activity you authorize and for taking reasonable steps to secure your account.
2. Your content and our permission to process it
You retain your rights in the notes, recordings, files, messages, and other material you add (“Your Content”). You grant Tuck a limited, nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and technically process Your Content only as needed to provide, maintain, and secure the Service and carry out your instructions, including syncing, transcription, reminders, integrations, and sharing you enable. We may use service providers for those purposes under appropriate obligations.
Your data is not training material. Tuck never uses your content or personal information to train, fine-tune, or improve AI or machine-learning models. Providers we engage to process data on our behalf, including for Tuck-hosted AI, are not permitted to use that data for those purposes. A third-party AI provider you connect through your own account is governed by the separate terms and settings described below. This applies to private and shared content, recordings, transcripts, attachments, prompts, responses, and information accessed through integrations. We do not sell your content or personal information, use it for advertising, or publish private content without your instruction.
We deliberately minimize collection and retention. We collect and retain only the information reasonably needed to provide the features you choose, secure and operate Tuck, and meet legal obligations. We do not retain extra copies of your data to build training datasets or for unspecified future uses. Content you choose to keep in Tuck remains available under your account and storage settings; operational data and deleted content follow the specific retention and deletion periods in these Terms and our Privacy Policy.
The limited processing license ends when the content is removed from our systems, except for copies retained as described in the Privacy Policy or required by law. Your instructions to share content may leave copies with recipients that we cannot remove.
You must have the rights and permissions needed to upload, record, import, process, and share content, including other people’s personal information and workplace material. Obtain any legally required consent before recording or transcribing people. Clipping a page or importing a document does not give you ownership of someone else’s work.
3. Encryption, recovery, and device storage
Tuck encrypts vault content on your device before syncing it. Signing into your account and unlocking your vault are separate steps. We cannot decrypt protected vault content or replace missing decryption material. If you lose your passphrase, recovery materials, and access to an unlocked device, your encrypted content may be permanently inaccessible.
Encryption does not mean every use of Tuck is end-to-end encrypted. Email and SMS pass through their providers and Tuck’s capture service before entering your vault. Reminder text and delivery information, certain organizational metadata, content you publish, and information processed through enabled integrations have different protections, as described in the Privacy Policy and feature disclosures. Enabling an external AI feature may transmit the selected content to its provider.
An unlocked device can provide access to your content. Pending browser-extension clips may remain locally before they are encrypted into the vault. Lock shared devices and protect recovery materials. Device loss, clearing browser storage, uninstalling software, or sync failures can affect locally stored or unsynced data. Keep independent copies of important information. A recovery kit restores access to an available encrypted vault; it is not a backup of its contents.
4. Sharing and collaboration
You choose what to share and with whom. A shared tuck may be a snapshot that does not reflect later edits. Public links can be forwarded and accessed by others. Recipient-restricted shares and shared brains follow the access controls shown in the product; check those controls before sharing sensitive information.
Shared-brain owners and other participants may have permission to change content or access. Your access can end if the owner removes you, closes the shared brain, or deletes their account. Removing a person, revoking a link, or deleting content cannot erase copies already downloaded, copied, or otherwise retained by recipients. Tuck cannot guarantee recovery of collaborative changes or resolve ownership disputes between participants.
5. Plans, payments, and cancellation
Current offers are part of an early-adopter pricing test. Prices offered to new customers may change; that does not override commitments made to existing customers. Your purchase screen identifies your plan, included features, price, currency, billing interval, and applicable taxes. Recurring plans renew for the interval you select until canceled. By separately authorizing recurring billing at checkout, you authorize those renewal charges. We will disclose any trial conversion and its price before you enroll; a free account alone does not authorize a paid subscription.
You can cancel renewal in Settings → Account → Subscription using Cancel renewal, or contact support@tuckthis.app if that option fails. Cancellation stops future renewals; paid access continues through the paid period unless you request earlier account deletion. Removing an app or browser extension does not cancel a subscription.
You may request a full refund within 30 days after your first paid purchase, including a Founder purchase, by contacting support@tuckthis.app. This voluntary guarantee applies to your first paid purchase, not subsequent renewals or later purchases. When we issue the refund, the refunded paid entitlement ends and future renewals for that purchase are canceled; your account becomes subject to the Free plan and the downgrade provisions below. Any mandatory rights to refunds, withdrawal, or remedies remain unaffected. We may suspend paid features after unsuccessful payment, with notice and a reasonable opportunity to resolve the issue where practicable.
For plans sold with a starting-price guarantee, your original base subscription price stays the same while you continuously maintain the same plan, billing interval, and currency. A new pricing catalog alone does not change that price. Canceling renewal does not end the guarantee if you reverse the cancellation before your paid access expires. If you resubscribe after paid access expires, or change your plan, billing interval, or currency, the price displayed and accepted by you at that time applies. Applicable taxes may change independently of the guaranteed base price. Promotional terms apply only as disclosed when offered. We do not charge usage overages without your affirmative agreement.
6. Founder access
The Founder purchase provides five years of prepaid Tucker-equivalent access, 200 GB of attachment storage during that period, and the additional benefits specifically listed at purchase. The prepaid term begins on the purchase date and its end date will be shown in your account. Founder status is a designation, not an ownership interest, investment, revenue share, or right to control Tuck.
Founder is not a lifetime subscription. At the end of the five-year term, continued paid access requires a Tucker subscription at the then-current price. We will email you a reminder 30 days before your prepaid access expires. Continuing paid access requires a new affirmative subscription purchase; the Founder payment alone does not authorize an automatic charge. Founders receive 200 GB of attachment storage whenever they have an active paid Tucker subscription, including when they resubscribe after a lapse. A lapse does not remove this storage benefit; resubscription pricing follows the pricing provisions above. If you do not subscribe, your account moves to Free, subject to the storage transition below. Your Founder designation remains regardless of whether you subscribe. The designation alone does not provide perpetual paid features, storage, community availability, or roadmap sessions. No particular future feature is promised unless expressly included in your purchase.
7. Fair use and plan limits
Tuck is designed for individual capture, organization, and collaboration. Ordinary personal and business use is welcome, including supported imports and personal automations. It is not a general-purpose file-hosting service, public download network, bulk messaging platform, or service for reselling access.
Each thought may contain up to 12 attachments. Each file may be up to 8 MB (8,388,608 bytes), measured on your device before encryption. These per-thought and per-file limits apply across plans. Your total plan storage allowance is measured separately using stored encrypted attachment data, as explained below.
Attachment storage allowances are:
| Plan | Attachment storage | Monthly SMS segments | Hosted AI |
|---|---|---|---|
| Free | 250 MB | 0 | Not included |
| Pro | 5 GB | 200 | Not included; own-provider integration available |
| Tucker | 100 GB | 200 | Not yet available; allowance TBD at launch |
| Founder, during the prepaid term or any active paid Tucker subscription | 200 GB | 200 | Not yet available; allowance TBD at launch |
Storage usage is measured by the size of the encrypted attachment data stored by Tuck, including encryption overhead, rather than the original unencrypted file size. For these allowances, 1 MB means 1,048,576 bytes and 1 GB means 1,073,741,824 bytes. Archived attachments continue to count. Separately uploaded copies count separately. Attachments in a shared brain count against the shared-brain owner’s allowance, not each collaborator’s allowance.
SMS. Paid plans include 200 SMS segments per account per calendar month.North America, some of South America, and some of the EU. For exceptions in service, click here. The allowance is shared across incoming captures and outgoing reminders and replies. Allowances reset at 00:00 UTC on the first day of each month and do not roll over. A segment is a carrier-sized portion of a text; long messages and certain characters can use several segments. Verification codes and STOP/HELP messages do not count toward your allowance. We will display usage and notify you at 80% and 100% of your allowance. Some numbers can text Tuck without receiving reminder texts. For those numbers, reminders go by email, and we text only to verify the number and for STOP, START, and HELP. At the limit, SMS capture and SMS reminders pause until your allowance resets or you affirmatively purchase additional capacity, if offered. We do not automatically charge overages. Email reminder fallback is used only if you have enabled it. Without an enabled fallback, a reminder affected by the SMS limit will not be delivered by SMS while that limit applies. Program details: SMS reminders.
Hosted AI — forthcoming. Hosted Tuck AI is not yet available. Its usage allowance is to be determined and will be published when the feature launches, before you enable or use it. No launch date or numerical allowance is promised by these Terms. Before activation, we will disclose the applicable plan eligibility, usage measurement, reset period, limits, any separate charges, and how the feature processes your content. No additional charge will apply without your affirmative agreement. This does not override any specific commitment made at purchase.
Your own AI provider. If you choose to connect your own third-party AI account, you authorize Tuck to send the content needed for the AI feature you use to that provider. We will explain what information is sent and to whom before you enable the feature. Tuck does not use that content to train models. However, the provider’s processing, retention, and any use for model training are governed by your agreement with that provider and your account settings. We do not control those terms or settings and cannot extend Tuck’s provider no-training guarantee to your independently connected account. Review the provider’s policies and disable training or data-sharing options if you do not want that use. Its charges are billed under your provider account; Tuck’s integration limits may also apply. Processing a request to produce an answer is separate from training a model.
Other resources. We may apply proportionate temporary rate limits to protect security and service availability. Examples include repeated automated requests that overload the service, email-forwarding loops, bulk unsolicited messages, public distribution of large files, or attempts to evade quotas through multiple accounts. High usage alone, especially within a purchased allowance, is not misconduct.
When usage causes a problem, we will ordinarily notify you, explain the affected feature, and offer reasonable steps to resolve it. We may pause affected activity immediately for security incidents, unlawful use, or ongoing service disruption. Restrictions should be limited to the affected feature where reasonably possible, and you can request review at support@tuckthis.app.
We will not impose retroactive overage fees or silently reduce a purchased allowance. Material reductions for an existing paid term require advance notice and an appropriate remedy, such as retaining the allowance through the paid term or offering cancellation with a refund for the unused affected period. Emergency temporary restrictions may take effect sooner.
8. Downgrades and excess storage
A downgrade, expired promotion, or the end of paid access may reduce your allowance. We will notify you of the change and explain how to reduce usage or select another plan. If your storage is full or exceeds your tier’s allowance, you can continue syncing existing content and ordinary note changes, but cannot add new attachments until you free enough space or move to a plan with sufficient storage. An attachment that would exceed your remaining allowance cannot be added.
After a downgrade, including the end of Founder prepaid access without a continuing subscription, we retain your existing files indefinitely while your account remains open, even if they exceed the new allowance. Existing content remains available to read, sync, download, and delete. There is no deadline to reduce excess storage, and we do not delete files solely because your account exceeds its storage allowance. New attachments remain blocked until sufficient space is available under your plan. This excess-storage policy does not prevent deletion you request or the separate account-closure, lawful-removal, and service-discontinuation processes described in these Terms and our Privacy Policy.
9. Messages, integrations, and automated features
Enable messaging only for an address or number you control or are authorized to use. By enabling SMS and completing the consent flow, you request the account and reminder messages described there. Message frequency varies; carrier message and data rates may apply. Reply STOP to opt out and HELP for assistance. SMS opt-out does not cancel your paid plan. Update your number promptly if it changes. North America, some of South America, and some of the EU. For exceptions in service, click here. SMS is not available on every network.
External calendars, mailboxes, AI providers, carriers, and other integrations have their own terms and availability. You authorize Tuck to access and process the information necessary for features you enable. Disconnect integrations and revoke provider credentials when you no longer want that access. Provider charges are your responsibility when disclosed and authorized through that provider.
Transcripts, inferred dates, generated text, suggested actions, imports, and reminders can be incomplete, incorrect, delayed, or duplicated. Review them before relying on them or sharing them. Tuck does not guarantee delivery or correct interpretation of a deadline. Do not rely on it as your only system for emergency communications or critical medical, legal, financial, or safety obligations.
10. Acceptable use
Do not use Tuck to violate law or others’ rights; distribute malware; harass, exploit, or defraud others; send unsolicited bulk messages; access accounts or systems without permission; evade security or usage controls; or materially interfere with the Service. Do not sell shared account credentials or resell the Service without our agreement. These restrictions do not limit rights that applicable law gives you, including lawful interoperability or security research. Report security concerns to support@tuckthis.app.
Report unlawful content or infringement to abuse@tuckthis.app, identifying the material, its location, the rights involved, and how we can contact you. We may restrict access to material or accounts when reasonably necessary to address a substantiated complaint or comply with law, with notice and an opportunity to respond where appropriate.
11. Changes, suspension, and closing an account
We may update the Service and offer experimental features. Early-access features may change or be discontinued, but that label does not remove your rights concerning paid services. We may suspend or terminate access for a material breach, nonpayment, legal requirements, or a serious security threat. Where practicable, we will explain the reason and allow you to fix the issue or challenge the decision.
You may delete your account using the account-deletion option in Tuck or request deletion by emailing privacy@tuckthis.app. Before closing your account, preserve copies you need and coordinate shared-brain access with collaborators. Account deletion, billing cancellation, removal of local device data, and removal of other people’s copies are separate processes. We will explain the effect of your request and stop future subscription renewals as part of confirmed account closure.
When you delete your account, we mark it as deleted and retain its data for 30 days before automatically purging it from our active systems. You do not need to send a separate email to initiate that automatic purge. To request earlier erasure of your personal information, email privacy@tuckthis.app. Certain records may be retained as required by law. These exceptions do not permit continued ordinary use of your deleted account data.
We keep automated backups of the database that stores accounts and encrypted vault data for 7 days so we can restore the service after a failure. We do not keep those backups longer. Copies of deleted data may remain in these backups until they expire. Because active-system purge occurs 30 days after account deletion, backup copies may remain for up to 7 additional days after that purge.
Other retention and deletion practices, including legally required records, are described in our Privacy Policy. We cannot recover encrypted content without the required keys or erase copies outside our control.
If we permanently discontinue a paid service or end your paid access for reasons other than your material breach, we will give 30 days’ advance notice where reasonably possible and allow you to download your available content during that notice period. We will refund the unused prepaid service period. This includes the unused portion of a Founder term, calculated proportionately over five years. This does not limit mandatory remedies.
12. Tuck’s intellectual property
Tuck and its licensors retain rights in the Service, software, branding, and other materials apart from Your Content. We give you a limited right to use the Service under these Terms. Separate open-source licenses govern components covered by those licenses. You may choose to send feedback, and we may use it without payment or attribution; this does not transfer ownership of your private content.
13. Disclaimers and responsibility
We will provide the Service with reasonable care and skill. Subject to mandatory law and express commitments in these Terms, the Service is provided “as is” and “as available,” without additional warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose.
To the extent permitted by law, neither party is responsible for indirect or consequential losses, lost profits, or lost business opportunities arising from this agreement.
To the extent permitted by law, Tuck’s aggregate liability arising from the Service is limited to the greater of US$100 or the fees you paid for the Service during the 12 months before the event giving rise to the claim. For a claim arising during a Founder prepaid term, the full Founder purchase price counts toward this cap even if paid more than 12 months earlier. Refund obligations expressly provided above are not reduced by this cap.
Nothing excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer remedy that cannot lawfully be excluded or limited.
14. Disputes and general terms
Contact legal@tuckthis.app so we can try to resolve a concern. This does not prevent you from pursuing legal remedies, contacting a regulator, or meeting a filing deadline. These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. Subject to mandatory consumer rights, disputes may be brought in the state or federal courts serving Fayette County, Georgia. If you are a consumer living elsewhere, this choice does not deprive you of mandatory protections under the laws of your usual residence or any right to bring a claim in your local courts. These Terms do not require arbitration or waive your right to participate in class proceedings.
We will provide at least 30 days’ advance notice of material changes to these Terms by email or an in-app notice, unless a shorter period is reasonably necessary for legal or security reasons. Changes apply prospectively. Where required, we will obtain your consent. If a change materially reduces a prepaid service and you do not accept it, you may cancel the affected service and receive a proportionate refund for its unused term.
These Terms and the specific purchase terms accepted by you form our agreement about the Service. Specific purchase commitments control over inconsistent general descriptions. If a provision is unenforceable, the remainder continues to apply. Failure to enforce a provision is not a waiver. We may transfer this agreement as part of a merger, reorganization, or sale of the Service only if the successor assumes our obligations and your rights are not materially reduced. Mandatory rights remain unaffected.
